Academic Free License ("AFL") v. 3.0

This Academic Free License (the "License") applies _ any original work of authorship (the "Original Work") whose owner (the "Licensor") has placed _ following licensing notice adjacent _ the copyright notice for _ Original Work:

  3. Grant of Source Code License. _ term "Source Code" means _ preferred form of _ Original Work for making modifications _ it _ all available documentation describing how _ modify _ Original Work. Licensor agrees _ provide a machine-readable copy of _ Source Code of _ Original Work along with each copy of _ Original Work that Licensor distributes. Licensor reserves _ right _ satisfy this obligation by placing a machine-readable copy of _ Source Code in an information repository reasonably calculated _ permit inexpensive _ convenient access by You for as long as Licensor continues _ distribute _ Original Work.

  4. Exclusions From License Grant. Neither _ names of Licensor, nor _ names of any contributors _ the Original Work, nor any of their trademarks _ service marks, may be used _ endorse _ promote products derived from this Original Work without express prior permission of _ Licensor.   11. Jurisdiction, Venue _ Governing Law. Any action _ suit relating _ this License may be brought only in _ courts of a jurisdiction wherein _ Licensor resides _ in which Licensor conducts its primary business, _ under _ laws of that jurisdiction excluding its conflict-of-law provisions. _ application of _ United Nations Convention _ Contracts for _ International Sale of Goods _ expressly excluded. Any use of _ Original Work outside _ scope of this License _ after its termination shall be subject _ the requirements _ penalties of copyright _ patent law in _ appropriate jurisdiction. This section shall survive _ termination of this License.

  12. Attorneys’ Fees. In any action _ enforce _ terms of this License _ seeking damages relating thereto, _ prevailing party shall be entitled _ recover its costs _ expenses, including, without limitation, reasonable attorneys' fees _ costs incurred in connection with such action, including any appeal of such action. This section shall survive _ termination of this License.

  13. Miscellaneous. If any provision of this License _ held _ be unenforceable, such provision shall be reformed only _ the extent necessary _ make it enforceable.

  14. Definition of "You" in This License. "You" throughout this License, whether in upper _ lower case, means an individual _ a legal entity exercising rights under, _ complying with all of _ terms of, this License. For legal entities, "You" includes any entity that controls, _ controlled by, _ is under common control with you. For purposes of this definition, "control" means (i) _ power, direct _ indirect, _ cause _ direction _ management of such entity, whether by contract _ otherwise, _ (ii) ownership of fifty percent (50%) _ more of _ outstanding shares, _ (iii) beneficial ownership of such entity.

  15. Right _ Use. You may use _ Original Work in all ways not otherwise restricted _ conditioned by this License _ by law, _ Licensor promises not _ interfere with _ be responsible for such uses by You.
